Is a new Nuremberg trial in Ukraine possible? In any case, on Thursday in Strasbourg, the Council of Europe unanimously called for the creation of an international special court to prosecute the Russian leaders, but also the Belarusians, who are said to be responsible for the war in Ukraine.
Since the International Criminal Court, based in The Hague, has jurisdiction only for war crimes and against humanity and not for the “crime of aggression,” Russia, Belarus, and Ukraine are not signatories to the treaty that established the court.
“The crime of aggression? It is the decision to ignite an international conflict illegally. (…) It has been forbidden to wage war since the end of World War II. It is not a legitimate extension of political or diplomatic activity.” , stresses the chairman of the Committee on Legal Affairs and Human Rights of the Council of Europe Damien Cottier, Friday in La Matinale de la RTS.
And to add: “In the judgment of Nuremberg it is written that the crime of aggression is the supreme crime because it permits all other crimes. (…). If we do not judge the concept of the crime of aggression, we only do it half the job. It’s like bringing half the criminals to justice.”
