Chief Justice of Canada Richard Wagner said in a written statement that on Monday he took note of Justice Russell Brown’s decision to “resign from his office as Justice of the Supreme Court of Canada, effective immediately.”
He was appointed to the Supreme Court on August 31, 2015 and has been absent since February 1 “while the Canadian Judiciary Council considered a complaint against him,” it said.
The council announced on Monday that it was now considering the matter in light of Judge Brown’s resignation.
Russell Brown has vigorously denied allegations that he was drunk and molested a group of friends at an event in Scottsdale, Arizona, honoring another judge.
Since February 1, the court has been sitting with five or seven judges, as provided for in the law on the Supreme Court. It is noted that for many years the Court has often met with nine, seven or five judges.
Chief Justice Wagner is urging Prime Minister Justin Trudeau to “exercise all due care and diligence to appoint a new Justice to the Supreme Court of Canada as soon as possible”.
“On behalf of the Court, I would like to recognize Justice Brown’s contribution over the past eight years and wish him well in his future endeavors,” the Chief Justice said.
