If you have ever used a Canadian government online account, this notice may affect your rights. Please read it carefully. You may receive more than one authorization notice due to possible unauthorized access to more than one of your Canadian Government online accounts.
Todd Sweet has filed a class action lawsuit against the Canada Revenue Agency (“CRA”) and the Government of Canada (collectively, the “Defendant”) alleging that the Defendant acted negligently in protecting Canadians’ confidential information, resulting in widespread privacy have violations. The Canadian federal court approved the class action lawsuit against the defendant. Todd Sweet is the deputy plaintiff.
The plaintiff alleges, among other things, that the Canadian government violated the privacy of group members by failing to adequately protect confidential personal and financial information stored electronically on various online government portals. The plaintiff argues that these inadequate security measures allowed malicious actors to access Canadians’ online accounts, view confidential and private information and, in many cases, request the CERB without their consent.
The plaintiff requests that the court order the Canadian government to pay compensation for, among other things, the alleged invasion of privacy and the credit monitoring services that may be required to repair the damage caused.
The Canadian government has denied any wrongdoing on its part. In the trial, a judge will decide who is right. The date of this process has not yet been set.
Who is part of the action?
The class action lawsuit is being filed on behalf of anyone whose personal or financial information contained in their Canadian government online account was disclosed to a third party without authorization between March 1, 2020 and December 31, 2020, excluding the disqualified individuals.
means “Canada Government Online Account”:
- a) My Canada Revenue Agency file;
- b) My Service Canada Account;
- c) another online Canadian government account accessed through the Government of Canada Branded Credential Service (GCKey).
“Excluded Person” means any person who contacted Murphy Battista LLP prior to June 24, 2021 regarding the CRA data breach class action, including Federal Court Docket Number: T-982-20.
If you fall under the class definition above, you are automatically part of the class action. You don’t have to do anything to participate. If you do not wish to participate in the Promotion, you must notify the Class Advisor by post or email at the address below by November 27, 2023 at the latest that you wish to opt out. If you are a member of the class and do not opt out of the class, you may not bring a separate claim against the Government of Canada for specific personal damages you may have suffered. The class action seeks damages for the entire class action. The judge decides how this compensation is divided among the group members.
If you do not wish to participate in the Class Action, you must opt out. If you opt out of the class action, the outcome of the class action, whether positive or negative, will not apply to you. If you choose to opt out of the class action, you will not be entitled to any funds received under the class action, but you retain your right to sue the government on your behalf, subject to any statute of limitations. If you still wish to opt out of the class action, you must print/scan, complete and submit the opt-out form or submit your full name, address, date of birth and a statement that you wish to opt out of the class action. Class members who wish to opt out of the class action must send their opt-out form to the above address or email by November 27, 2023. Class members who do not file an opt-out form by November 27, 2023 will still be part of the class action until November 27, 2023.
You don’t have to pay anything to participate in the class action lawsuit. Lawyers appointed by the court to represent the group will only be paid if the group wins its case. If necessary, the attorneys will seek a percentage of the total amount received from the group and reimbursement of their out-of-pocket expenses. This percentage cannot exceed 33.33% and must be approved by the court.
